At Omypal.com, we respect and uphold the intellectual property rights of others and are committed to complying with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws. This DMCA Policy outlines the steps we take to address notifications of copyright infringement and provides guidance on how to contact us if you believe your copyrighted material has been used on our platform without proper authorization.

1. Reporting Copyright Infringement

If you believe in good faith that materials made available through Omypal.com (the “APP”) infringe your copyright, you (or your agent) may send us a notice requesting that we remove the infringing material or block access to it. Your notice must include the following information in writing:

  • a. An electronic or physical signature of the owner (or a person authorized to act on behalf of the owner) of the copyrighted work;
  • b. A description of the copyrighted work that you claim has been infringed, along with sufficient information to help us locate the material on the APP;
  • c. Your name, address, telephone number, and email address;
  • d. A statement by you that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  • e. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.

2. DMCA Notices Response

Upon receiving a complete infringement notice, we will take the following actions:

  • a. Review the notice to ensure it complies with DMCA requirements;
  • b. Take appropriate preliminary action, which may include removing or disabling access to the allegedly infringing material, typically within 1-3 business days after receiving the notice;
  • c. Notify the alleged infringer of the claim and request a response or counter-notice, if applicable.

3. Counter Notification

If you believe in good faith that a DMCA notice of copyright infringement has been wrongly filed against you, you may send us a counter-notice. The counter-notice must include:

  • a. Your name, address, and telephone number;
  • b. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of a mistake or misidentification;
  • c. A statement that you consent to the jurisdiction of the federal court in your district and that you will accept service of process from the person who filed the original DMCA notice;
  • d. Your physical or electronic signature.

Upon receiving a valid counter-notice, we will notify the original complainant. The process will be held for 10-14 days before the material is re-enabled, unless the copyright owner initiates legal action against you during that time.
